A parent company is liable for its subsidiary and vice versa. This is the conclusion reached by the European Court of Justice. For many years, it has been common practice for the EU Commission to hold a parent company liable for a breach of EU competition rules committed by a subsidiary if the parent company has a decisive influence on the subsidiary. The European Court of Justice has now established that the same also applies in the opposite direction.
