Swedish tax authorities have lost a lawsuit regarding aggressive tax planning.

EU Law: The European Court of Justice has concluded that Swedish tax rules are incompatible with the right to freedom of establishment, which is a fundamental freedom in the EU. Thus, Sweden has lost a legal battle regarding the right to deny foreign companies access to deduct intra-group interest deductions. The European Court of Justice ruled that denying these deductions constituted discrimination against non-Swedish companies.
